Club Cahaba Terms & Conditions

Welcome to Cahaba Dermatology & Spa. Please read and understand these Membership terms and conditions (Membership Terms). Once you click “I agree”, you agree to the Membership Terms as a legally binding contract between you and Cahaba Dermatology & Spa. If you do not want to agree to these Membership Terms, please do not agree at this time and contact our office with any questions you may have.

1. Payment Plan Agreement Contract

MONTHLY PAYMENT PLAN MEMBERSHIPS

Applies to memberships where payments are made every month during the duration of the membership term.

You understand and agree that you have committed to a contract and you agree to membership fees payable by you at the rate offered at purchase time every month for the full duration of membership term.

You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Cahaba Dermatology & Spa cancels it.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Cahaba Dermatology & Spa with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Cahaba Dermatology & Spa to charge all Subscription fees incurred through your account to any such payment instruments. Should automatic billing fail to occur for any reason, Cahaba Dermatology & Spa will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Cancellation of MONTHLY PAYMENT PLAN

You understand that you may not cancel your membership for the full membership term. Cancellations may be approved by management in the event of medical illness or diagnosis which prevents you from receiving products or treatments in the plan. Cancellations may also be approved in the event that member relocates or moves more than 40 miles from Cahaba Dermatology & Spa. For cancellation to be approved member must submit documentation of medical illness or diagnosis by a licensed medical provider or mortgage/lease along with utility bill outside of a 40-mile radius from Cahaba Dermatology & Spa. In the event of any cancellation Cahaba Dermatology reserves the right to request the member to repay to office the value of treatments/products and discounts received but not already paid for.

FULLY PAID PAYMENTS

Applies to memberships where payments are made up front for the full duration of the membership term.

You understand and agree that you have committed to a contract and have entered a binding contract for the full duration of membership plan.

Cancellation FULLY PAID PAYMENTS

You understand that you may not cancel your membership for the full membership term nor will refunds of payments be granted. Cancellations may be approved by management in the event of medical illness or diagnosis which prevents you from receiving products or treatments in the plan. Cancellations may also be approved in the event that member relocates or moves more than 40 miles from Cahaba Dermatology & Spa. For cancellation to be approved member must submit documentation of medical illness or diagnosis by a licensed medical provider or mortgage/lease along with utility bill outside of a 40-mile radius from Cahaba Dermatology & Spa. In the event of any cancellation Cahaba In the event of cancellation refunds will be issues less the value of treatments/products and discounts received.

2. Membership

If you are under 18 years, you need your parents’ permission before becoming a member. Your Membership is non-transferable. Members may use the benefits of membership as long as membership account remains in good standing.

3. Refusal, Suspension or Termination of membership

We may, in our discretion, immediately restrict, suspend or terminate your membership and access to the Site if we consider you in breach of these Membership Terms, any other Site rules, or applicable law. We reserve the right to refuse membership in our discretion (examples include previous breaches of membership terms on any other program.

4. Liability and Disclaimer

In no event shall Cahaba Dermatology & Spa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

5. Changes to Membership Terms

We may change Membership Terms from time to time, but we will notify members before doing so. Changes will only be applied at the end of your membership term and you may opt out or cancel any automatic renewal.
